Companies Pavan Duggal, an Indian cyber law expert and Supreme Court advocate, has argued strenuously that India should adopt stringent cyber laws for preservation of confidentiality and strict punishment for cyber crimes. “Gambling is a state subject in India. IT Act is also silent on this. Most states have anti-gambling laws though some in the North East have not passed any and therefore it is possible to have operations legally from there,'' says cyber law expert Pavan Duggal. Says Pawan Duggal, cyber law expert, penalty for hate crime does not fall in the ambit of IPC. And the clause that can question such activities is an ambiguous Section 67 of the IT Act which makes “publishing, transmitting or causing to be published information in the electronic form which is likely to deprave and corrupt the minds of people who are likely to see/ read the same,” punishable.
